What counts as adequate disclosure under ASA, FTC, and ACCC rules?
All three regulators require disclosure to be upfront, prominent, and unambiguous. Buried hashtags, small text, vague language like 'collab' or 'gifted', or disclosure that requires clicking 'read more' do not meet the standard. #ad or 'Paid partnership' clearly labelled at the start of the content is the baseline.
Does gifting count the same as being paid?
Yes. Under UK ASA, US FTC, and Australian ACCC rules, any material connection — including free products, experiences, or travel — requires disclosure. The value of the gift does not change the obligation.
